The full import of that thesis is staggering, for it essentially means that national sovereignty is itself illegitimate that, contrary to the eloquent statement of principle in our Declaration of Independence, particular nations of people cannot determine for themselves the course of their own government or the terms and conditions on which others, not already part of the political community, may join. Because no one has a choice about where they are born, it is argued, then laws restricting immigration amount to a birthright lottery from which some unjustly benefit at the expense of others. Some recent efforts in legal and social science scholarship, which have challenged the very notion of immigration and naturalization laws, provide support for that claim. Which leaves us with what the true nature of the UndocuBus claims must be, namely, that any limits on immigration and naturalization are inherently unjust. That is a generous immigration policy, perhaps not as generous as some would like, and the process could certainly be streamlined to be more efficient, but it is hardly an unjust policy. The United States admits to lawful permanent residency more than one million immigrants every year, or about 10 percent of our total population every 30 years. Second, the claim that the existing immigration laws are so unjust that civil disobedience on a massive scale is warranted is hard to sustain. Those engaged in the UndocuBus effort are seeking to force an amnesty for those who have knowingly and willfully violated the law. Under that authority, Congress has established a naturalization and immigration policy, through laws that, by their own admission, the UndocuBus riders have violated. Article I, Section 8 of the Constitution assigns to Congress the power to “establish a uniform Rule of Naturalization,” and that clause has long been interpreted to give Congress the power to establish immigration policy as well. By flouting the law, the UndocuBus riders are pursing the delegitimization of our most basic understandings of sovereignty.įirst, it is beyond dispute that Congress has the constitutional authority to set the terms by which foreign nationals can enter the United States and become naturalized citizens.
